Terms of Use

Who these terms are between
These terms are the agreement between you and Programmatic SEO B.V., registered at Brouwerijstraat 1, 7523 XC Enschede, under Chamber of Commerce number 93094299. They apply to the website, the iOS app, the Android app and everything in them.
By creating an account or by using the service without one, you accept these terms. If you do not accept them, do not use the service.
If you run a shop on Your Fashion Deal, a second agreement also applies to you: the Store Partner Terms. Where the two differ for shop activity, the Store Partner Terms win.
What Your Fashion Deal is, and what it is not
Your Fashion Deal is a place to discover fashion deals through short videos. Shops publish their offers, we show them, and you decide what interests you.
It matters that you understand the limits of our role:
- We are not the seller. When you decide to take a deal, you leave Your Fashion Deal and land on the shop's own website, and any purchase you make is between you and that shop.
- We do not set prices, we do not hold stock, we do not take payment and we do not ship anything.
- The shop is responsible for the accuracy of its deal: the price, the discount, whether the item is actually available, and the terms of the sale.
- Your rights as a consumer for a purchase, including returns, guarantees and refunds, are against the shop and are governed by the shop's terms and by the law that applies to it.
We do check deals before they are published, and we remove ones we find to be misleading. That check is not a guarantee, and it does not make us a party to your purchase.
Age and eligibility
You must be at least 16 years old to use Your Fashion Deal. We ask for your date of birth when you create an account and we refuse accounts below that age.
You must also have the legal capacity to enter into this agreement, and you must not be barred from using the service by a previous termination.
Your account
- Give accurate information, and keep your email address current so we can reach you.
- Keep your password to yourself. You are responsible for what happens under your account until you tell us it has been compromised.
- One person, one account. Do not share it and do not sell it.
- Tell us promptly if you think someone else has access.
You can close your account at any time from your profile, or from the account screen in the app. Closing it deletes your data as described in the Privacy Statement.
The rules
Our Community Guidelines set out in plain language what may and may not be posted. They form part of these terms, and you can read them at https://yourfashiondeal.com/community-guidelines.
In addition, when using the service you must not:
- Break the law, or help anyone else to.
- Post content you do not have the rights to.
- Impersonate another person, shop or brand.
- Harass, threaten, or abuse anyone.
- Interfere with the service: no scraping, no automated access, no attempt to get around rate limits, no probing for vulnerabilities without our written permission.
- Reverse engineer, decompile or copy any part of the service, except to the extent the law says you may.
- Use the service to send spam or to advertise something unrelated.
Your content, and the permission you give us
Everything you post stays yours. Posting it does not transfer ownership to us.
To be able to show it, we do need your permission. By posting a photo, video, comment or deal, you grant us a worldwide, non-exclusive, royalty-free licence to store it, display it, resize and re-encode it for different screens, include it in the feed and in search results, and feature it in material promoting Your Fashion Deal. This licence lasts as long as your content is on the service, and ends when you delete it, except for copies we must keep for the moderation and legal reasons set out in the Privacy Statement.
You confirm that you have the rights you are granting, and in particular that:
- The content is yours, or you have permission from whoever owns it.
- Anyone recognisable in a photo or video has agreed to appear.
- Showing the content does not break anyone else's rights.
You are responsible for the content you post. We are not obliged to keep a copy of it, so keep your own.
Our content and our brand
The service itself, including its software, design, text, and the Your Fashion Deal name and logo, belongs to us or to our licensors. You may use the service as intended, and nothing more. Do not use our name or logo without written permission, except to link to us.
Deals, prices and availability
Deals come from shops and change constantly. A deal may sell out, expire, or be withdrawn by the shop before you get to it. Prices, discount percentages and availability are the shop's statements, not ours.
If you see a deal that looks wrong or misleading, report it. We would rather hear about it than leave it up.
Links to shops and other sites
The service contains links to websites we do not run. We choose which shops may publish, but we do not control their sites and we are not responsible for what is on them. Their terms and their privacy statements apply once you arrive.
Moderation, suspension and termination
We can remove content, reject a deal, restrict what an account can do, suspend an account, or close it. We do this when content or behaviour breaks these terms, the Community Guidelines, or the law.
Whenever we take one of those steps against you, you get:
- A statement of what we did and why, unless the law prevents us from telling you.
- The specific rule we relied on.
- Whether the decision was made by a person or by automated means. Today it is always a person.
- A way to object, and the deadline for doing so.
How to object is set out in our Reporting and Moderation Policy at https://yourfashiondeal.com/reporting. We look at every objection and we reverse decisions we get wrong.
We may also suspend the service or an account immediately, without notice, where there is a serious risk to users, to a third party or to the service itself. Where we do, we tell you as soon as we reasonably can.
Availability and changes to the service
We try to keep the service running, but we do not promise it will always be available. We may change features, add them or remove them. Where a change materially reduces what the service does for you, we will tell you in advance if we reasonably can.
Our liability
We are liable for damage caused by our intent or gross negligence, for death or personal injury, and wherever Dutch law does not allow liability to be limited. Nothing in these terms excludes that.
Beyond that, and to the extent the law allows:
- We are not liable for what a shop does, including a deal that turns out to be inaccurate, an item that is not delivered, or a refund that is not paid.
- We are not liable for content posted by users.
- We are not liable for indirect or consequential loss, lost profit, or lost data.
- Where we are liable, our total liability is limited to the direct damage suffered, up to a maximum of 500 euro per event or series of connected events.
If your content causes us a claim
If someone brings a claim against us because of content you posted or because you broke these terms, you will cover the reasonable costs we incur in dealing with it. This does not apply to the extent the claim arises from something we did.
Complaints
If something goes wrong, tell us. Describe what happened and what you would like us to do. We acknowledge complaints within two working days and aim to answer substantively within ten.

Which law applies
Dutch law applies to these terms, and disputes go to the competent court in the Netherlands.
If you are a consumer living in another country in the European Union, you keep the protection of the mandatory consumer law of your own country, and you may also bring a claim in the courts there.
Changes to these terms
These terms have a version number and an effective date, shown at the top of this page. If we change something that affects you, we tell you in the app and by email at least 14 days before it takes effect. If you do not agree with a change, you can close your account before it applies.
App licence
This section is the licence agreement for the Your Fashion Deal mobile app. It applies in addition to the rest of these terms.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use. Shop accounts may use it for their own shop.
You may not:
- Copy, modify, translate or create derivative works of the app.
- Reverse engineer, decompile or disassemble it, except to the extent the law expressly permits.
- Rent, lease, lend, sell, sublicense or distribute the app.
- Remove or obscure any notice of ownership.
- Access the service by any automated means, or build a competing service from what you learn.
Objectionable content and abusive behaviour are not permitted, at all. We operate a zero tolerance policy: content that is offensive, abusive, discriminatory, sexually explicit, threatening or otherwise objectionable is removed, and the accounts of users who post it or who abuse other users are terminated. You can report content and block another account from inside the app, and every report reaches a person.
The app updates itself through the app store. Some updates are needed for the app to keep working with our service.
This licence ends if you stop using the app, if you delete your account, or if we terminate it because you broke these terms. When it ends, delete the app.
Apple and Google are not parties to this agreement and have no obligation to provide support or maintenance for the app. This agreement is between you and us alone. Where you obtained the app from the Apple App Store, Apple may enforce these licence terms as a third-party beneficiary, and any claim about the app failing to conform to a warranty is ours to handle, not Apple's.
The app includes third-party open source components. Their licences are listed in the app under Settings, and where an open source licence conflicts with this section, that licence prevails for the component it covers.
